+ Guarantees or Warranties

All Sales are final with no refunds or exchanges. Switzer’s Auction does not guarantee or make warranties on any lot. We acknowledge that errors may occur, however we endeavor to give you accurate information in descriptions provided. We are available by email (admin@switzersauction.com) and phone (613-332-5581) to answer questions and provide additional photographs prior to bidding if required. We strongly recommend you personally view any item you bid on. No employee of Switzer’s Auction is authorized to make any representation or warranty, oral or written, with respect to any lot or item for sale. Switzer’s Auction will not return or refund money if an item is not exactly in the same condition as listed in online listing. Firearm ratings in the online listing are subjective and are of visual opinion, no mechanical inspection or test firing is undertaken by Switzer’s. Any concern must be addressed with a recognized gunsmith prior to firing any firearm.

+ Firearm and Ammunition Purchases

CANADIAN BIDDERS: Firearm, Ammunition, and Cartridge Magazine purchasers require a valid P.A.L. (Possession and Acquisition License). All restricted and prohibited firearms are registered with the Canadian Firearms Program and will be transferred to the purchaser following the completion of the sale and receipt of full payment. It is the purchaser’s responsibility to determine that they have the correct category of license for the intended purchase prior to bidding. You will require a P.A.L. for all Prohibited/Restricted/Non-Restricted category firearms. No P.A.L. is required for Antique category firearms.
Cartridge Magazine, Ammunition and Firearms must be shipped to an address on file with the CFO. Ammunition and Firearms cannot be shipped in the same box. Ammunition will be shipped with UPS or Purolator depending on your location and restrictions. We must ship Ammunition to your address on file with the CFO.
Any items that are purchased that we are not able to deliver/ or you don’t have a valid license to possess will be sold at the next opportunity, regular commission charges apply to that secondary sale.
As we are selling Firearms, Ammunition and Cartridge Magazines, it is imperative that bidders/customers provide us their correct information. We require your full correct name as shown on your PAL, PAL number, date of birth, the mailing address that is associated with your PAL. If you have made an error and need to correct it, please email admin@switzersauction.com.

+ Pick Up

If you are Picking Up your items please see lot 0D on our most recent auction for further instructions.

+ Shipping

If we will be Shipping your items please see lot 0E on our most recent auction for further instructions. Due to legislated restriction we cannot ship any Police / RCMP Uniforms, Equipment or any other Police / RCMP articles to Nova Scotia. Please check your provincial laws / restrictions before bidding on these items.

U.S.A. & INTERNATIONAL BIDDERS:

+ Shipping Limitations

Please be advised that we cannot ship any sort of firearm, directly to USA or International buyers. Buyers must use a third-party exporter for these items. In our sale these are lots 1-6699.

+ Items We Will Not Ship Internationally (Including to the USA)

Due to tariff and shipping regulations, we will not ship the following categories to USA or international buyers. Do not bid on these items if you require shipment outside Canada.

• Air guns • Ammunition • Archery • Gun parts • Inert munitions or grenades • Magazines, Stripper clips • Military equipment • Military helmets • Military parts • Bullets, Dummies, BB's or Pellets • Non Primed brass, Primed brass or Primers • Receivers • Scopes (if Military) • Stocks

In this sale, these categories are generally associated with lots 10000–15999, 19000-22999, 26000-26899, 28000–28999, 36000-36999. These cannot be shipped by us or an exporter. Do not bid on these items.

+ Country‑of‑Origin Restrictions

Some items cannot be imported into the USA based on the country of manufacture (e.g., Russia, China, Cuba, Iran, etc.). You are responsible for confirming that you may legally receive the item in your jurisdiction before bidding.

+ Confiscation by Border/Customs Agencies

We are not responsible for items seized or confiscated by customs or border agencies. No refunds will be issued in these cases.

+ USA & International Bidding Approval

All USA and international bidders will receive an email requesting confirmation that they have read, understand, and accept these Terms & Conditions. Accounts will not be approved until the bidder replies confirming acceptance. To request approval, email admin@switzersauction.com.

+ Using a Third Party Exporter: USA Bidders

You are solely responsible for ensuring your purchase is importable. Your U.S. FFL/importer will be required to file the necessary paperwork with ATF (U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives). Check with your FFL and/or ATF regarding the import of specific items. Not all firearms or related items are importable/exportable into the USA. Any item purchased and later deemed “not importable/exportable” will be resold at the next opportunity; regular commission charges apply to that secondary sale.

+ Tariffs, Duties, and Shipping: USA Bidders

Please note that tariffs and duties may be charged on items going to the USA. These assessments are based on the original place of manufacture, not the point of purchase. Rates fluctuate and are assessed on the day of shipping. Switzer’s Auction uses UPS for shipments to the USA. Any duties, tariffs, taxes, or brokerage fees are the buyer’s responsibility.

+ Using a Third Party Exporter: International Bidders

You are solely responsible for ensuring your purchase is importable into your country. Confirm with your governing authority and with your chosen exporter that export/import is permitted prior to bidding. Not all firearms or related items are importable/exportable internationally. Any item purchased and later deemed “not importable/exportable” will be resold at the next opportunity; regular commission charges apply to that secondary sale.

+ Tariffs, Duties, and Shipping: International Bidders

For buyers outside the USA, tariffs, duties, taxes, and import fees may be assessed by your local customs authority. These charges vary by country and by the item’s original place of manufacture. All such charges are the buyer’s responsibility.

Storage fees of $5.00 per item per month will be charged on all items that we have not been able to send to your exporter within 120 days of the sale. If you are unable to complete the transaction within 1 year, the lots will be resold at a subsequent auction. Regular commission charges apply to the resale.

If you encounter issues signing up for our sale, you may enter all zeros in the firearms licence field to bypass this requirement. Thank you

ALL BIDDERS:

+ Bidder Registration

As we are selling Firearms and Ammunition it is imperative that bidders/customers provide us their correct information. We require your full name as shown on your PAL, license number, date of birth, mailing address that is associated with your PAL. When this information is incorrect it will cause a delay in both the processing and shipping of your purchase.

+ Buyer's Premium and Taxes

All items purchased online are subject to a 15% buyer's premium. Canadian Taxes will be charged at the rate applicable to the shipping destination. Item(s) purchased and shipped outside of Canada are not subject to Canadian taxes, however you may be responsible for customs or duty charges.

+ Terms of Payment

At the conclusion of the Auction, all items won will be charged to the Visa or Mastercard provided at registration to guarantee payment. If shipping is required for any purchase, an additional charge will be applied on the day the item is to be shipped. Please ensure that we have the correct card number and expiry date on file.

Important: Transfers of any Prohibited or Restricted firearms will not be initiated until full payment has been received. If full payment is not received within 30 days of the auction close, the items may be resold in the next available sale.

Bidders are responsible for full payment of all items upon winning. Switzer’s Auction will take all necessary steps to recover unpaid balances in order to mitigate losses. This may include charging your credit card in partial amounts until the full amount is received. If payment is not received within 14 days, a late fee of 2% may be applied to the outstanding balance.

Any items won that are not paid in full, Switzer’s Auction reserves the right to resell those items at the next available auction. Our standard commission fees will apply to the resale. Any outstanding balance remaining after the resale may be referred to a collection agency and/or pursued through small claims court.

Recurring late payers will be banned from future sales.

If your credit card or shipping information changes after registration, please email us at admin@switzersauction.com. Please note that iCollector only forwards your information at the time of registration and does not transmit updates.

+ Bidding

The highest bidder shall be the purchaser and the decision of the auctioneer relating to all matters is final. Pre-bids are time stamped and the earliest bid will win any tie situation. All sales are final and not subject to conditions.

All merchandise is sold 'As Is' without recourse to the vendor. All goods advertised or displayed are subject to withdrawal prior to sale within the discretion of the auctioneer.

The Auctioneers may reject a bid at their discretion without reason or explanation. Bid increments are fixed for online only auctions. Bid increments are fixed for the pre-bidding and maximum bid portion of Online/Live auctions. Once the sale goes Live the Auctioneer has the option to adjust the bid increments.

Placing your bid is your acceptance of all Terms and Conditions, Buyers Premium, Taxes, Shipping, Pick up and Payment information. Please read them before bidding.

Bid retractions will only be permitted when we have made a gross description error, obvious customer bid input errors ($5000.00 instead of $500.00). In the case that we have to resell a lot to a back bidder your are responsible for the difference between your bid and theirs, there will also be a $50 administration fee charged, buyers premium and taxes. + NEW REGULATIONS CONCERNING THE TRANSFER / SALE OF NON-RESTRICTED FIREARMS. THESE ARE LOT NUMBERS: 2000-4699

Reference # Requirement

With these regulations, it has become necessary to obtain a reference number from the RCMP to validate the license of purchasers prior to the transfer, (shipment or pickup) of a non-restricted firearm. This reference # is for the seller (us) the buyer (you). This reference # is good for 90 days. We will obtain the reference #’s as required.

New Identification Requirement

If you are picking up your item, you will be required to show your PAL when you pick up.  

If we are shipping a non restricted firearm we are now required to confirm the validity of the purchasers PAL by viewing the PAL as well as the front of one other piece of Government issued photo identification. 

If you are a winning bidder on a non-restricted firearm in upcoming sales, you will receive an email notification from us requesting an uploaded photo of your identification documents. We will require this information prior to shipping any non restricted items. This information will not be stored by us, and we must receive new uploads prior to every shipment. We have developed a very simple and secure way for you to do this. There will be a link provided in the email.

+ Consignor Bidding

Consignors are not authorized to bid on their own items or have someone bid on their behalf. We reserve the right to withdraw any items or bids made by the offending consignor.

+ Limitations of Liability

Except as expressly provided above, all property is sold “As Is'. Switzer's Auction nor the Consignor makes any representation or warranty, express or implied, as to the title, merchantability, fitness or condition of the property or as to the correctness of description, genuineness, attribution, provenance or period of the property or as to whether the purchaser acquires any copyrights or other intellectual property rights in lots sold or as to whether a work of art is subject to the artist's moral rights or other residual rights of the artist. All Firearms and Ammunition are sold as Collector lots only. Fitness to fire or otherwise discharge the Firearm or Ammunition is expressly denied by Switzer's Auction. A competent Gunsmith should be consulted before attempting to use or fire any Firearm or Ammunition. The Purchaser expressly acknowledges and agrees that in no event shall Switzer's Auction be liable for any damages including without limitation any compensatory, incidental or consequential damages.

The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. Specific condition requests can be obtained via email at admin@switzersauction.com. Any statement given is strictly an opinion and should not be treated as a statement of fact. Switzer's Auction shall not be responsible for any error or omissions in lot listings.

+ De-activations

We are licensed to perform de-activations. Prices to de-activate vary depending on the type and complexity of the work needed to be performed. We de-activate to the Canadian Firearms Technical Inspection standard, this standard may not meet the standard for export to foreign Countries. Please email admin@switzersauction.com for quotes to de-activate prior to bidding, minimum fee is $150.00 and can increase to $450.00 + for a complicated fully automatic machine gun. Firearms de-activated by Switzer’s will be reported to the Canadian Firearms Registry and once approved a letter of de-activation will be provided.

We sell firearms that have been previously de-activated by others, these may not meet current or exportable standards. Firearms de-activated by other may or may not have a “de-activation letter” available. We are not able to search for letters for firearms de-activated by others.
